Barry McAlinden successful in appeal to the Court of Appeal

Appearing before Richards, Jackson and MacFarlane LLJ. Barry McAlinden successfully appeared for the grandmother of 4 children in care proceedings in an appeal against a decision of HHJ Tolson QC. The appeal concerned the implementation of a care plan for placement of the children with the grandmother, under a care order, by the respondent local authority. Taking into account that, following the final order the provision of suitable accommodation to the grandmother by the local authority had not occurred within the timescales originally envisaged, and the need to take a pragmatic approach to resolving that, the Court approved the parties’ agreed position of dealing with the matter by consent and for its remission back to the trial judge for reconsideration [2018/0016/A&B]
