Victoria Flowers'  article, published in the Elder Law Journal (ELJ 2011, Volume 1, 432), considers the Court of Appeal authority of AVS (by his litigation friend CS) v NHS Trust and B PCT [2011] EWCA Civ 7, [2011] 2 FLR 1 (Ward, Patten and Black LJJ) and the circumstances in which the Court of Protection should not act, including that the Court should not be used to twist the arms of clinicians.
