Miriam Shalom is a busy practitioner specialising in civil disputes with a particular emphasis on property litigation

She has acted for a wide range of clients and always aims to provide her clients with representation that advances their interests and is efficient and cost sensitive. She has an approachable manner and seeks to put her clients at ease.

She regularly appears in the High Court and County Court as well as in tribunals.

Miriam has taught Contract law at Kings College London and was a judicial assistant in the Court of Appeal where she gained experience in a broad range of civil appeal.

Miriam is a qualified Public Access barrister.

Areas of expertise

Trusts of land

Miriam acted as in the leading case of Stack v Dowden and has represented clients in a large range of trust disputes including those involving former cohabitants and family members. She has advised, settled proceedings and conducted trials in disputes relating to ownership of land, the validity of express trusts, entitlement to occupation rent and the sale of property.

She has also acted in trusts of land disputes involving insolvency or an enforcement of debt aspect.

Landlord & tenant

Miriam acts for both landlords and tenants in commercial and residential property matters including claims for possession, rights to succeed relief from forfeiture and damages for disrepair. She acts for local authorities as well as private clients. She regularly appears both in court and in tribunals dealing with landlord and tenant issues.

She recently acted in an appeals concerning the requirements for the surrender of a tenancy and also dealing with the public law defences to possession claims.

Miriam has given seminars on this area.

Probate & Inheritance Act disputes

Miriam has undertaken both advisory and advocacy work in relation to the validity and interpretation of wills, as well as claims under the Inheritance Act relating to the reasonableness of dispositions.

She is able to bring a sensitive approach to an area that can be fraught with emotional issues as well as legal challenges.

In addition to appearing in the High Court and County Court Miriam has been involved in mediations that have led to successful resolutions of such matters.

Boundaries & easements

Miriam acts in matters involving questions of the existence and extent of easements as well as boundary disputes.

She is able to combine a fact sensitive approach with complex legal analysis in dealing with these types of cases.

Contract

As well as having taught at undergraduate level on this area of law Miriam has advised drafted proceedings and acted for clients in numerous cases involving aspects of contract law, such as the interpretation of clauses, the validity of agreements and formality requirements.
