Harrison Engler represents the mother in case invoking unusual application of s.1(3)(f)Children Act

Harrison Engler acted for the mother in proceedings where the court applied section 1(3)(f) Children Act 1989 in an unusual way. The mother and all the children had additional needs, including a genetic learning disability. The mother had made allegations of abuse against the children’s father. The court made a child arrangements order in the mother’s favour and directed no contact occur between the children and their father.

Tony Harrop-Griffiths acts for local authority in Court of Protection appeal considering differing approaches to assessing mental capacity

Tony Harrop-Griffiths represented the local authority in an appeal before the Vice President of the  Court of Protection against a decision that CT, a 55-year-old man, lacked capacity to make decisions about residence and care.
The local authority was supporting the appeal which was brought by Official Solicitor. Mental health charity Mind was an intervenor in the proceedings.
