Nikolas Clarke recently succeeded, in a personal injury claim arising out of a road traffic accident, at trial. He acted for the defendant, whose case was that the claimant had not been in the vehicle at the point of impact. The evidence was such that an explicit allegation of fraud was made in the Defence. The Judge found that to be correct and dismissed the claim accordingly, with an order that the claimant pay costs to be assessed on the indemnity basis.
