Rebecca Davies represented a mother in private children law proceedings involving counter-allegations of domestic abuse.
She acted for her from the fact-finding to final hearing stage.
The case concerned 2 children, both below the age of 10 throughout the proceedings.
The situation was complicated by:
- the close links between the maternal and paternal family,
- interim orders being made by the High Court without reference to Practice Direction 12J, and
- the interaction of domestic abuse and coercive and controlling behaviour with the applications for passport orders and port alerts
- the need for evidence to be given from different jurisdictions.
On the mother’s behalf, Rebecca successfully argued:
- no findings be made against her client
- all abuse findings be made against the father, and
- that the passport order and port alerts be discharged.
She also achieved her client’s objective in terms of a final outcome of supervised contact between the father and the children.
