Christine Cooper represents successful local authority in judicial review application about remotely-conducted Care Act assessment

Christine Cooper represented the London Borough of Ealing which successfully defended an application for judicial review concerning a Care Act assessment carried out remotely. The claimant was refused permission for a judicial review.

Background to the case

The claimant challenged the local authority’s Care Act assessment of his needs which found he no longer needed care and support now that he had adequate housing.

He argued that the Care Act assessment should not have been conducted remotely (even though he had agreed to it).

The court rejected that saying it was a thorough assessment which also took into account a lot of other material.
